Both access and use of the website nordikas.com, as well as the purchase of its products, are subject to the acceptance by users of the Purchase Terms and Conditions ("TCC") of the portal.

Before starting to use the services offered on nordikas.com, make sure you have carefully read all Purchase Terms and Conditions. These might be amended from time to time, and therefore it is always advisable to have a look at them every time you are going to buy something. Nevertheless, in case there were any changes, nordikas.com shall notify it through the portal, newsletter, or other equivalent means.

User Registration

For placing an order, users don't need to register, but for some other of our services, they need to do so by filling in the registration form, where they shall be asked to provide some personal information, which must be real and updated. At the end of the registration process, users must accept these Purchase Terms and Conditions as well as our Privacy Policy.

User ID and password must be kept in a safe place.

Once users have a user ID and password, they can access the section "My Account" (log in) where they can modify their registration data, as well as view and track their orders' status.

If you have forgotten your user ID and/or password, please click on the "I have forgotten my password" link once you have accessed "log in". The system shall send you an email with a new safe password, which you can then modify with the option "Modify your password".

In the event that you detect any improper use of your registration information, please contact nordikas.com through hola@nordikas.com immediately.

Users state that they are of full age (over 18 years) and that they have sufficient legal power to contract the services offered by nordikas.com. They further declare that they abide by this agreement and they understand and accept all the conditions included herein for the use of this web and the contracting of the services offered.

Access Denied / Suspended Users

The use or access to the website of nordikas.com constitutes acceptance of the "General Terms", therefore any user who breaches any of the obligations set forth in these "General Terms" may be suspended and denied access to the website.

Any user who intentionally or culpably breaches any of the obligations reflected in this legal notice is liable for any damages caused to nordikas.com or third parties as a result.

Orders

To place an order on our website, you need to enter personal information: real name, shipping address, email address, phone number, and other information. You must also enter information about the payment. This must be valid and correct.

Order Acceptance

Once items have been selected and the order process has been completed, you will receive an email with the details of your order. This email is just a confirmation that we have received your order and does not imply acceptance. The acceptance and completion of the distance selling contract will take place when the shipping is made.

The sales contract is carried out in Spain, and the language used is Spanish.

Nordikas.com accepts orders only if you comply and accept the terms and conditions of purchase and the product ordered is available. Nordikas.com reserves the option not to accept the order when payment information is not approved, the items are not in stock, the quality of the article is not acceptable, transportation problems to the required destination are foreseen, or any other type of incidence relative to the terms of use of the site is detected.

Items added to the shopping cart by the user are not reserved, and consequently, any other user may buy them.

Payment and Prices

You can pay with the following credit cards: Visa, MasterCard, American Express, 4B. You may also use the PayPal platform.

Nordikas.com uses a secure payment platform with payment data encryption.

Nordikas.com does not keep on file information concerning the details of the cards used.

Neither COD orders will be accepted.

When using a debit/credit card, users confirm that the card used is owned by them or they have been duly authorized by the owner for its use. Transactions with credit/debit cards are subject to a security check and validation by the issuer. In the event that the entity which has issued the card refuses the transaction, nordikas.com shall not be held liable for delays or cancellations of shipments.

To pay by bank transfer, you must make a deposit with the order quantity and description, specifying the order number and customer name.

If that does not specify the order number in the description, processing times may suffer delayed order.

Processing times and shipping the order began to run from that payment for the order is confirmed, and the shipping confirmation email is sent.

Prices for the articles applied on nordikas.com are entered at the beginning of the campaign and are expressed in euros (EUR). Applicable VAT (Value Added Tax) is included. In the case of Switzerland, Norway, Ceuta, Melilla, Andorra, and the Canary Islands, delivery takes place in DDU (Delivered Duty Unpaid), and therefore the price of the items is invoiced without VAT, as established by the law, and users will be responsible for the payment of any fees or applicable taxes. In the summary of their order on the confirmation and payment section, users can check the prices of their orders without VAT.

Prices in currencies other than euros are just for information purposes. Prices expressed in other currencies are subject to fluctuations in the exchange rates and may therefore vary.

Payments and refunds of all shipments will be made in euros (EUR). If your credit/debit card is not denominated in euros, the exchange rate shall be that applied by the relevant bank entity according to market exchange rates and may differ from the price shown in nordikas.com.

Any purchase orders made within the European Union shall be sent under the terms DDP (Delivery Duty Paid), which means that the final prices include the relevant taxes and duties. If the shipment is made to a country with applicable duties (such as Switzerland, Ceuta, Melilla, and the Canary Islands), in the event of return, neither processing costs nor duties shall be refunded. Please contact your nearest customs manager to have the said amount refunded.

Prices shown in nordikas.com do not include shipping costs. In section 3.6. (below) you will find information on transportation costs allocated to each country, depending on the volume of your purchase.

Shipping. Destinations, Shipping, and Insurance Costs.

Prices of the items reflected in nordikas.com do not include shipping. These costs will be added proportionately to products purchased depending on the destination, powered by the sales management operating system of nordikas.com and will be reflected in the detail of the invoice before the customer accepts the payment order (except for special offers with no shipping costs and always in accordance with the conditions described in the said special offers that must be previously published in nordikas.com).

Transportation cost varies depending on the destination and purchase volume. Shipping costs:

Weight intervals are closed, for instance, a 2 kg parcel (4.4 pounds) would be within the 0-2 kg rate. Articles shall be counted with 1 kilogram scales (otherwise it would be indicated).

Transportation shall be carried out by the messenger company SEUR (domestic shipments) and UPS (international).

Delivery dates are just for information purposes and do not take into account possible delays due to payment authorizations or exceptional transportation conditions. In the normal course of events, orders placed before 02:00 PM are usually delivered on the following day. Subsequent orders shall be sent on the following workday and usually arrive two days after. No orders are delivered on Saturdays, Sundays, and holidays.

Nordikas.com insures all parcels during transportation until orders are delivered to the address indicated by users.

For completing the purchase process, all orders must be signed when they are received, at which moment users take responsibility for articles bought. In the case that an article has been bought to be sent to another person (for instance, presents), users accept as valid the signature of another person in the receipt place, and this person also takes responsibility for the goods.

Once orders have been invoiced, you shall receive a confirmation email including the order number for tracking. If you have registered as a user on the online shop, you can track your order by accessing your account through the section "Log In". You can also access information about your order through "My Orders".

Exchange and Refund.

Exchange and Refund Policy. Parcels are picked up for free.

For exchanging any article of your order, you must ask within the period of 14 days following the receipt of the order and return the goods within the period of 14 days following the receipt in your email address of the return/exchange authorization report.

The refund shall be made within a maximum period of 30 days from the moment on which the goods reach our premises and once we have checked that the product has been returned in perfect conditions. The refund shall be made with the same payment method selected when the products were purchased. Shipment costs shall not be refunded.

All articles must be returned in perfect condition, without having been used, and with the original bags, boxes, labels, tags, and packaging. Please try the shoe on on a carpeted surface in order to avoid marks on the sole. We may refuse to accept the return or exchange if the goods have any damages.

Exchanges and refunds must always have the exchange/return authorization report attached for the goods to be identified in our premises. This report must be signed by you. Any returns and exchanges received without the return/exchange authorization report and their return code may be returned to the sender.

All articles undergo a quality control to detect flaws or damages before shipping them. In the event that you receive an article that is not in perfect condition, please contact us immediately by sending an email to hola@nordikas.com.

Returns.

In order to return an article, please follow these steps:

At the upper part of the screen, access "Log In". In the box "Direct Access to Orders", enter your email address and order number.

Once you are in the order, select "Exchange and Return", choose the articles you want to return, mark "Return", and select the reason for return to help us improve.

Accept the conditions of our exchange and return policy.

Please note that the cost of return shipments is at the customer's own expense.

Once the returned goods are received and checked, we will notify you by email. The refund shall be made a couple of days after the receipt and checking of the articles returned and always within the period of 30 days following receipt. Should you have any questions regarding the return and exchange process, don't hesitate to contact hola@nordikas.com.

Exchange.

You may exchange articles only for a different size or for the same size in the case of faulty items, and the exchange shall be subject to the availability of stock in our warehouses. If you wish to exchange your article for a different model, please return the purchased article(s) and place a new order.

Follow the same process described under the section "Return" above. Select the option "Exchange" and specify the new size you need.

In order to effectively complete processes, we kindly ask you to carry out all exchanges and/or returns of an order in just one consignment.

Cancellation of an Order under Regulation DSR (Distant Selling Regulation).

In accordance with the DSR (Distant Selling Regulation), if you have placed an order from a country within the European Union, you are entitled to cancelthe order by sending a notification in writing up to 7 working days after its receipt.

To proceed with the return under Regulation DSR, you must send a communication to hola@nordikas.com or a formal writing asking for a DSR return, indicating the order number and the items you want to return to:

For those orders canceled under DSR regulation, you shall receive a full refund of their cost, including transportation costs. Once you have requested the cancellation of your order under these regulations, you shall receive an email confirming the return, which you must include in the consignment.

All returned articles must be in perfect conditions and must never have been used. The return must be carried out from the country where the goods were delivered.

We shall refund the full cost of your order, including transportation costs, within a maximum period of 30 days from the time of receipt in our warehouses and once we have made sure the articles are in good conditions.

Faulty Items

a) Faulty Items Delivery

All articles undergo a quality control in order to detect damages or faults before shipping them. In the event that you receive an item that is not in perfect conditions, follow the exchange and/or return process, which is described above, within the period of 14 days after your order is delivered.

b) Items with Latent Defects That Can Only Be Detected After Their Use

There may be latent manufacture defects that can only be detected once the article has been used. Please bear in mind that articles damaged due to wear and with tears cannot be considered items delivered with faults.

If you detect any latent defect within the six-month period after the receipt of the item, please don't hesitate to contact us by sending an email to hola@nordikas.com. Please attach a description of the problem and, if possible, photographs bearing witness to it. In case that items do have manufacture faults, we shall manage their collection.

The acceptance of faulty items shall take place once our technicians have inspected them after their receipt in our premises. In the case of faulty items, we shall try to fix them whenever possible. If the repair was not feasible, we shall proceed to replace them with other identical ones and of the same size. We shall only refund the purchase amount in case that the items can neither be repaired nor be replaced (except importation fees or tariffs for Switzerland, Norway, Ceuta, Melilla, the Canary Islands, and Gibraltar).

Intellectual Property

The whole content is the property of nordikas.com and is protected by intellectual property domestic laws and international treaties.

The use of the portal and its contents does not confer any content title transfer rights on users (copyrights, trademarks, logos, images, graphics, pictures, etc.) including the computer code, any programs, and databases.

Any reproduction, distribution, spreading, or any other kind of exploitation of the aforementioned contents is strictly prohibited and may result in a violation of laws currently in force.

Unauthorized Commercial Use

Both this portal and its content are meant to be used by end consumers.

Contents, articles, and services included in this portal cannot be modified, copied, distributed, transmitted, reproduced, published, exploited for commercial purposes, transferred, or sold.

The use or exploitation of this portal, its contents, products, and services for commercial purposes is strictly prohibited for persons and entities other than nordikas.com.

Legislación Aplicable

Las condiciones generales de uso y cualquier otra política de nuestro portal están sometidas a la legislación española. Cualquier litigio será sometido a la jurisdicción de los juzgados y tribunales de Alicante (España).

Nordika's Liability

Nordika's, S.L. reserves the right to introduce modifications both in the website nordikas.com and in these general terms and conditions.

On the other hand, and bearing the especial nature of the communication medium through which the communication with users takes place in mind, nordikas.com cannot accept liability in these cases:

For temporal impossibility to gain access to the website at a specific moment, to the concrete information he/she needs from the ones included in nordikas.com, or to those websites he/she gains access to by clicking hypertext links placed on this website.

For the accuracy of the contents, information, product offers, and services available or for whether they are updated or not. In nordikas.com, there is information that has been simplified or written in such a way that they are easier for the average user to understand, and therefore Nordika's, S.L. accepts no liability for possible wrong constructions of the information contained in the website, except in the event of negligence by the owner of nordikas.com in his/her duties, as described in these "general terms and conditions".
